Richter Merchan hatte die Geschworenen angewiesen, zu prüfen, ob Trump gegen ein New Yorker Gesetz gegen „Verschwörung“ zur Wahlbeeinflussung sowie gegen ein Bundesgesetz zur Wahlkampffinanzierung verstoßen wollte. Auch instruierte er die Geschworenen, „alle persönlichen Meinungen oder Voreingenommenheiten“ zugunsten oder gegen den Angeklagten beiseite zu lassen.
