Turkey and the Council of Europe: the essence of Kavala

Imprisoned culture pastor Kavala is back on trial. The Council of Europe threatens Turkey with expulsion because of this process. But the method there is complex and influenced by many concerns.

Today, human rights and culture promoter Osman Kavala, who has been imprisoned for four years without a sentence, is being tried again in Istanbul – in a case involving human rights activists, the Turkish opposition, diplomats and journalists from the European Union alike: the incumbent prosecutor and, in particular, accusing him Turkish President Recep Tayyip Erdogan financed the Gezi protests in 2013 and participated in the attempted coup in 2016 – based on allegations that, according to the consensus of independent observers, are unfounded.

The day of the trial is very exciting because the Council of Europe threatened Turkey with infringement proceedings in September over Kavala’s proceedings – the deadline for that is November 30. Then the next three-day meeting of the body responsible for such cases begins in the Council of Europe. The threat came after a ruling by the European Court of Human Rights that Turkey had not implemented in over a year. Because this acquitted Kavala in May 2020 of all the allegations of the Turkish judiciary. Turkey ignores the ruling, despite being a member of the Council of Europe, it is bound by the decisions of the European Court of Human Rights.

Complex removal process

If at least two-thirds of the 47 member states of the Council of Europe vote in favor of the measures against Turkey, it can be disqualified. Frank Schwab, a member of the Social Democratic Party in the Bundestag and in the parliamentary group responsible for human rights, assumes that this two-thirds majority exists: there is even a clear majority, he says. Erdogan can only avoid the abuse proceedings by changing course during Kavala’s trial.

People familiar with the case are talking about house arrest rather than prolonged pretrial detention or release with a ban on travel abroad at the same time.

If the judiciary continues to prosecute Kavala and the Council of Europe takes the expulsion procedure seriously, a long two-stage procedure will be followed, according to the Chambers of the Council of Europe: after the vote on the expulsion procedure, Turkey will be asked to comment with the corresponding deadline. Then, the council must refer the case back to the European Court of Human Rights by a two-thirds majority – the latter must check whether Turkey has now fulfilled its obligations.

If the European Court of Human Rights confirms Turkey’s fault, the governments of the countries represented on the Council must decide how to proceed. By a two-thirds majority, they can decide to exclude Turkey from the Council of Europe. However, from there it is said that there is no mechanism.

Azerbaijani precedent

In the history of the Council of Europe, there was only one measure of violation: Azerbaijan did not want the release of opposition politician Ilgar Mammadov for years, despite the acquittal of the European Court of Human Rights. Only when the council started proceedings against Azerbaijan did the regime there surrender. Mammadov spent five years behind bars.

Meanwhile, Ankara hopes that even if Kavala’s detention continues, the two-thirds majority will not be achieved next week. Among the 47 countries, there are some, such as Russia or Azerbaijan, that may face the same hardship that Turkey is currently facing due to politically motivated imprisonment. These are likely to vote against infringement proceedings. Additionally, in the run-up to the meeting at the end of November, Turkey could apply bilateral pressure on friendly countries to vote against the measure.

The credibility of the Council of Europe

Serge Lagodinsky, a green member of the European Parliament, has been following Kavala’s case for years and has repeatedly asked Turkey to release her. He says the government in Ankara has been trying to make progress in dialogue with the European Union over the past few months. To do so, however, it must meet the minimum standards of dialogue, that is, the human rights of the Council of Europe, and therefore also the judgments of the competent court, without condition or reservations. If Turkey does not release Kavala, says Lagodinsky, there should be consequences in the Council of Europe.

If a two-thirds majority is not achieved, it will seriously harm the institution of the Council of Europe and the Human Rights Court, which is part of the Council, according to SPD MP Schwabe. Hardly any of the 47 member states would take the European Court of Human Rights seriously.
